These Terms of Service govern your use of this website and the purchase of products from Kai & Stone (“we”, “us”, “our”). By accessing this website or placing an order, you agree to be bound by these Terms.

2. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law contained in the Competition and Consumer Act 2010.

Our goods come with guarantees that cannot be excluded under Australian law.

3. Personalised & Made-to-Order Products

All products are made to order and custom embroidered based on the personalisation details provided at checkout.

By placing an order, you confirm that:

  • All spelling, initials, names and personalisation details are correct
  • You have carefully reviewed your order before submitting
  • You understand that personalised items cannot be resold

We are not responsible for errors entered by the customer during checkout.

Change of mind does not entitle you to a refund for personalised items, subject to your rights under Australian Consumer Law.

4. Orders & Payment

All prices are listed in Australian Dollars (AUD).

We reserve the right to:

        - Refuse or cancel any order at our discretion

        - Cancel orders suspected of fraudulent activity        

        - Correct pricing or listing errors

If an order is cancelled after payment has been processed, a full refund will be issued.

5. Product Information

We make every effort to display product colours and details accurately. However, colours may vary slightly due to screen settings and lighting.

As embroidery is a handmade process, minor variations in stitching, thread placement, or fabric texture may occur and are not considered faults.

6. Shipping

Shipping timeframes provided are estimates only and are not guaranteed.

We are not responsible for delays caused by postal or courier services once an order has been dispatched.

Risk in the goods passes to the customer upon delivery.

7. Intellectual Property

All content on this website, including branding, embroidery designs, images, text and graphics, remains the property of Kai & Stone.

You may not reproduce, copy, distribute or use any content without prior written permission.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  • Indirect or consequential loss
  • Loss arising from incorrect information supplied by the customer
  • Delays outside our reasonable control

Nothing in this section limits your rights under Australian Consumer Law.

9. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms will be subject to the jurisdiction of the Australian courts.

10. Changes to Terms

We reserve the right to update or modify these Terms at any time. Continued use of the website constitutes acceptance of any changes.
